Start Murphy Limited is a professionally run and organised management and business consultancy with an aim to deliver first class professional management and business support services for our clients.

This document details the Terms and Conditions of Business that Start Murphy operate within when entering into an agreement with our client for the delivery of these services.

Our charges will be agreed with the client before the commencement of any project and this will be agreed in writing, by both parties, through the Start Murphy Limited Client Engagement Agreement document, which covers all aspects of the associated costs with an assignment.

If at any time before completion of the agreed project, you wish to vary the scope of the assignment, then you shall notify Start Murphy of the fact in writing and we shall use all reasonable endeavours to agree in writing the scope of such variation and how both the assignment fee and timescale shall be adjusted accordingly. However, no change to the project shall take effect until such agreement has been reached.

At Start Murphy we pride ourselves on delivering projects for clients on time, within budget and to an agreed service standard, with customer satisfaction centred at the heart of everything we do. However if, for whatever reason, there is a delay in project delivery due to circumstances beyond our control then Start Murphy reserves the right to charge the previously agreed fee in full.

Start Murphy will agree with you, prior to the commencement of the assignment, the Start Murphy team member who will support your organisation.

You shall be solely liable for the health and safety of any of our employees if any such employee attends your premises as part of the project.

In order to fully understand your organisation, we may be obliged to gather and analyse some financial data from your company’s accounts and other sensitive commercial information regarding your company. Please be assured that this information remains confidential and will never be disclosed to any other party.

To the extent permitted by law, our liability to you under our agreement shall be limited to the part of the contract price that has been paid in connection with the act or omission giving rise to the liability in question.

We may terminate the client agreement by written notice having immediate effect if:-

a) You fail to pay when due any sum payable to us under the agreement; and/or

b) You become insolvent, make or attempt to make any arrangement or compensation with creditors, or enter into liquidation, or otherwise become unable to pay your debts as they fall due.

Either party may terminate the agreement by giving [30] days notice to the other.

In the event of termination of the agreement, you shall pay such proportion of the fees payable as relate to the period in which we have performed the project until the effective date of such termination.

Any notice required or permitted to be given by either party to the other under the agreement shall be in writing addressed to the other party as its registered office or principal place of business.
